Thank you for taking the time to contact me with your thoughts regarding the use of medical marijuana. I appreciate hearing from you on this important issue.
As you may know, marijuana is currently listed as a Controlled Substance by the Drug Enforcement Agency (DEA) and listed as a Schedule I narcotic. Under California state law, patients and their primary caregivers are protected from criminal prosecution; however, the possession, sale, distribution and transportation of marijuana for medical use or otherwise remains illegal under federal law.
I understand the potential marijuana may have in providing relief to individuals diagnosed with certain serious illnesses. That is why I support federal research into determining what components of the marijuana plant can be used as medicine. To date, however, neither the FDA nor the Institute of Medicine have found smoking marijuana to meet the modern standard for safe or effective medicine for any condition. Science, not politics, should determine the availability of marijuana for medical purposes and, as a result I support medical research to that end. That said, however, I do not support legalizing marijuana for recreational use nor the deployment of dispensaries in our communities.

I am requesting that your “Office” reconsider your directives to prosecute Mr. Eric Salerno. I do not believe that the tax payers elected you to misuse your “powers” against legal patients, caregivers, Collectives and more alarming, ignoring State Laws as if it does not exist. .
It is 2012, and the citizens of the State of California have already addressed the rights for medical marijuana many, many years ago. I am sure there are residents in your County that are not abiding to the letter of the law. Perhaps your “Office” and local law enforcement should focus their time, energy and expenditures (of the tax payers money) chasing and prosecuting “bad guys” not legal medical marijuana patients, caregivers and Collectives.
In addition, I believe that the 3rd District Appeals Court has already ruled that your “Office” needs to uphold the “letter of the law” and based on that it appears that your “Office” does not have a “Case” and further action could be construed as “simply” vindictive.
Again, I trust your “Office” will do the right thing. If you would like to talk in detail, I would be happy to meet with you with a few days notice.
